PAYMENT TERMS

15% Structure
All fees will be invoiced immediately after the candidate commences employment and is payable within seven working days. The fee is based on a percentage (%) of the employee’s total annual cost to company.

Late payments - 15% Structure
If the fee is not paid within 7 days Benclo reserves the right to re-invoice at 17%.

GUARANTEE
Should a candidate resign or leave your employ, for any reason other than redundancy, pregnancy, death, disability or job misrepresentation, a replacement will be provided free of charge subject to the fee having been paid within the specified time, should the fee not be paid, the guarantee will be forfeited. If the replacement candidate should fall into a higher income bracket, a fee for the difference will be charged.
The guarantee is valid for three month (90 Days). The guarantee period operates from the day the employee starts for 90 days, and is conditional upon the invoice being settled in full within seven working days of commencement date.
If no replacement candidate is found, 75% of the fee will be credited.

APPOINTMENTS
Should any candidate put forward by us be employed by you within 12 months of last introduction a fee shall be applicable. Every care is taken by us to ensure that the capabilities and competence of candidates put forward by us meet your requirements based on the information provided to us.

ITC & CRIMINAL CHECKS
ITC Reports and criminal clearance checks are done on request by the company and subject to the applicant’s approval, this is a service we offer free of charge and can be requested on all your candidates.

TRAVEL COSTS
Should it be necessary for candidates or consultants to become involved in travelling, this will be arranged only with your prior approval and expenses incurred shall be for your account.

DOMICILIUM & JURISDICTION
Benclo consultants hereby chooses Domicilium Citandi Et Executand I for all purposes hereunder at the address appearing on all regular correspondence. In the event of a dispute arising out of this contract the partner hereby agree and consent to the jurisdiction of the Johannesburg magistrate court irrespective of the amount involved in such a dispute. In the event of you failing
to make payment timeously of any amount falling due to terms in this agreement, then all amounts outstanding shall immediately become due and payable not withstanding that such amounts is where not otherwise immediately due. You shall furthermore be liable for all costs and charges, including costs between attorney and client which the consultancy may incur in the recovery of any amount due rising out of this agreement.

ACCEPTANCE OF CONDITIONS
By agreeing to accept our papers or by interviewing our candidate, you tacitly accept these terms and conditions with reference to fee structure, payment conditions & legal jurisdiction.
No variation shall be accepted unless in writing.
